Factors associated with police shooting mortality: A focus on race and a plea for more comprehensive data

Objectives: To quantify nonfatal injurious police shootings of people and examine the factors associated with victim mortality.

Methods: We gathered victim-level data on fatal and nonfatal injurious police shootings from four states that have such information publicly available: Florida (2009–14), Colorado (2010–19), Texas (2015–19), and California (2016–19). For each state, we examined bivariate associations between mortality and race/ethnicity, gender, age, weapon, and access to trauma care. We also estimated logistic regression models predicting victim mortality in each state.

Results: Forty-five percent of these police shooting victims (N = 1,322) did not die. Black–white disparities were more pronounced in nonfatal injurious police shootings than in fatal police shootings. Overall, Black victims were less likely than white victims to die from their wound(s). Younger victims were less likely to die from their wound(s), as well as those who were unarmed.

Conclusions: Racial and age disparities in police shootings are likely more pronounced than previous estimates suggest.

Policy implications: Other states should strongly consider compiling data like that which is currently being gathered in California. Absent data on nonfatal injurious police shootings–which account for a large share of deadly force incidents–researchers and analysts must be cautious about comparing and/or ranking jurisdictions in terms of their police-involved fatality rates.

Black Lives Matter's Effect on Police Lethal Use-of-Force

A difference-in-differences design finds census places with Black Lives Matter protests experience a 15% to 20% decrease in police homicides over the ensuing five years, around 300 fewer deaths. The gap in lethal use-of-force between places with and without protests widens over these subsequent years and is most prominent when protests are large or frequent. This result holds for alternative specifications, estimators, police homicide datasets, and population screens; however, it does not hold if lethal use-of-force is normalized by violent crime or arrests. Protests also influence local police agencies, which may explain the reduction. Agencies with local protests become more likely to obtain body-cameras, expand community policing, receive a larger operating budget, and reduce the number of property crime-related arrests, but forgo some black officer employment and college education requirements.

Policies and Practices to Minimize Police Use of Force Internationally.

Injury and death from use of excessive force by police officers remain a common concern in countries across the globe. Despite local, national, and international attempts to legislate and provide guidance for police use of force, there continue to be global accounts of excessive force by law enforcement. Reports of officer-involved killings, injuries to citizens, and attempts to control protests and demonstrations with chemical irritants, rubber bullets, and sometimes shooting into crowds with live ammunition frequently appear in the press worldwide. However, reliable data on and accounting for these incidents are both lacking.

A large network of international and regional organizations, bilateral donors, international financial institutions, and civil society organizations aim to work with governments to improve policing practices and reduce police use of excessive force. As a part of that network, the U.S. Department of State, through its Bureau of International Narcotics and Law Enforcement Affairs (INL), provides foreign assistance to and supports capacity building for criminal justice systems and police organizations in approximately 90 countries. Like many donors, it strives to direct its resources to the most effective approaches to achieve its mission.

Policies and Practices to Minimize Police Use of Force Internationally, the third in a series of five reports produced for INL, addresses what policies and practices for police use of force are effective in promoting the rule of law and protecting the population (including the officers themselves). This report looks at what is known about effective practices and their implementation and identifies promising actions to be taken by international donors in their efforts to strengthen the effectiveness of law enforcement agencies.

Shooting to Kill: The Ethics of Police and Military Use of Lethal Force

Terrorism, the use of military force in Afghanistan, Iraq and Syria, and the fatal police shootings of unarmed persons have all contributed to renewed interest in the ethics of police and military use of lethal force and its moral justification. In this book, philosopher Seumas Miller analyzes the various moral justifications and moral responsibilities involved in the use of lethal force by police and military combatants, relying on a distinctive normative teleological account of institutional roles. His conception constitutes a novel alternative to prevailing reductive individualist and collectivist accounts. As Miller argues, police and military uses of lethal force are morally justified in part by recourse to fundamental natural moral rights and obligations, especially the right to personal self-defense and the moral obligation to defend the lives of innocent others. Yet the moral justification for police and military use of lethal force is to some extent role-specific. Both police officers and military combatants evidently have an institutionally-based moral duty to put themselves in harm's way to protect others. Under some circumstances, however, police have an institutionally based moral duty to use lethal force to uphold the law; and military combatants have an institutionally based moral duty to use lethal force to win wars. Two key notions in play are joint action and the natural right to self-defense. Miller uses a relational individualist theory of joint actions to construct the notion of multi-layered structures of joint action in order to explicate organizational action. He also provides a novel theory of justifiable killing in self-defense. Over the course of his book, Miller covers a variety of urgent topics, such as police shootings of armed offenders, police shooting of suicide-bombers, targeted killing, autonomous weapons, humanitarian armed intervention, and civilian immunity.
