Review of the Department of Justice's Response to Protest Activity and Civil Unrest in Washington, D.C. in Late May and Early June 2020

From the document: "The Department of Justice (Department or DOJ) Office of the Inspector General (OIG) undertook this review to examine the Department's and its law enforcement components' roles and responsibilities in responding to protest activity and civil unrest in Washington, D.C., between May 29 and June 6, 2020, following the murder of George Floyd on May 25. The report details the relevant events involving DOJ and its components during this time period, including their assistance to the U.S. Park Police (USPP) and the U.S. Secret Service (USSS) in and around Lafayette Park in connection with USPP and USSS plans to construct a fence on H Street after violence had erupted during protests on May 29; meetings attended by then Attorney General William Barr and other DOJ officials at the White House on June 1; Barr's involvement in the events at Lafayette Park on June 1; and DOJ's deployment of its law enforcement personnel on June 1 and on subsequent days. Thereafter we describe our analysis of these events, including whether Barr affected the timing of the clearing operation at Lafayette Park on June 1."

Shutting Down the Streets: Political Violence and Social Control in the Global Era

Recently, a wall was built in eastern Germany. Made of steel and cement blocks, topped with razor barbed wire, and reinforced with video monitors and movement sensors, this wall was not put up to protect a prison or a military base, but rather to guard a three-day meeting of the finance ministers of the Group of Eight (G8). The wall manifested a level of security that is increasingly commonplace at meetings regarding the global economy. The authors of Shutting Down the Streets have directly observed and participated in more than 20 mass actions against global in North America and Europe, beginning with the watershed 1999 WTO meetings in Seattle and including the 2007 G8 protests in Heiligendamm. Shutting Down the Streets is the first book to conceptualize the social control of dissent in the era of alter globalization. Based on direct observation of more than 20 global summits, the book demonstrates that social control is not only global, but also preemptive, and that it relegates dissent to the realm of criminality. The charge is insurrection, but the accused have no weapons. The authors document in detail how social control forecloses the spaces through which social movements nurture the development of dissent and effect disruptive challenges.

Report on Matters Related to Intelligence Activities and Investigations Arising Out of the 2016 Presidential Campaigns

From the document: "Following Special Counsel [Robert] Mueller's report, on May 13, 2019, Attorney General [William] Barr 'directed United States Attorney John Durham to conduct a preliminary review into certain matters related to the 2016 presidential election campaigns,' and that review 'subsequently developed into a criminal investigation. [...] On October 19, 2020, the Attorney General determined that, 'in light of the extraordinary circumstances relating to these matters, the public interest warrants Mr. Durham continuing this investigation pursuant to the powers and independence afforded by the Special Counsel regulations.' [...] [This] review and investigation, in turn has focused on separate but related questions, including the following: [1] Was there adequate predication for the FBI to open the Crossfire Hurricane investigation from its inception on July 31, 2016 as a full counterintelligence and Foreign Agents Registration Act ('FARA') investigation given the requirements of 'The Attorney General's Guidelines for FBI Domestic Operations' and FBI policies relating to the use of the least intrusive investigative tools necessary? [2] Was the opening of Crossfire Hurricane as a full investigation on July 31, 2016 consistent with how the FBI handled other intelligence it had received prior to July 31, 2016 concerning attempts by foreign interests to influence the Clinton and other campaigns? [3] Similarly, did the FBI properly consider other highly significant intelligence it received at virtually the same time as that used to predicate Crossfire Hurricane, but which related not to the Trump campaign, but rather to a purported Clinton campaign plan 'to vilify Donald Trump by stirring up a scandal claiming interference by Russian security services,' which might have shed light on some of the Russia information the FBI was receiving from third parties, including the Steele Dossier, the Alfa Bank allegations and confidential human source ('CHS') reporting? [...] [4] Was there evidence that the actions of any FBI personnel or third parties relating to the Crossfire Hurricane investigation violated any federal criminal statutes, including the prohibition against making false statements to federal officials? [...] [5] Was there evidence that the actions of the FBI or Department personnel in providing false or incomplete information to the Foreign Intelligence Surveillance Court ('FISC') violated any federal criminal statutes? [...]"

International Intervention and the Use of Force: Military and Police Roles

Intervening states apply different approaches to the use of force in war-torn countries. Calibrating the use of force according to the situation on the ground requires a convergence of military and police roles: soldiers have to be able to scale down, and police officers to scale up their use of force. In practice, intervening states display widely differing abilities to demonstrate such versatility. This paper argues that these differences are shaped by how the domestic institutions of sending states mediate between demands for versatile force and their own intervention practices. It considers the use of force by Germany, Italy, the United Kingdom and the United States in three contexts of international intervention: Bosnia and Herzegovina, Kosovo and Afghanistan. The paper highlights quite different responses to security problems as varied as insurgency, terrorism, organised crime and riots. This analysis offers important lessons. Those planning and implementing international interventions should take into account differences in the use of force. At the same time, moving towards versatile force profoundly changes the characteristics of security forces and may increase their short-term risks. This difficulty points to a key message emerging from this paper: effective, sustainable support to states emerging from conflict will only be feasible if intervening states reform their own security policies and practices.
