Racial and ethnic differences to the effects of state firearm laws: a systematic review subgroup analysis

Background

Despite growing evidence about how state-level firearm regulations affect overall rates of injury and death, little is known about whether potential harms or benefits of firearm laws are evenly distributed across demographic subgroups. In this systematic review, we synthesized available evidence on the extent to which firearm policies produce differential effects by race and ethnicity on injury, recreational or defensive gun use, and gun ownership or purchasing behaviors.

Main body

We searched 13 databases for English-language studies published between 1995 and February 28, 2023 that estimated a relationship between firearm policy in the USA and one of eight outcomes, included a comparison group, evaluated time series data, and provided estimated policy effects differentiated by race or ethnicity. We used pre-specified criteria to evaluate the quality of inference and causal effect identification. By policy and outcome, we compared policy effects across studies and across racial/ethnic groups using two different ways to express effect sizes: incidence rate ratios (IRRs) and rate differences. Of 182 studies that used quasi-experimental methods to evaluate firearm policy effects, only 15 estimated policy effects differentiated by race or ethnicity. These 15 eligible studies provided 57 separate policy effect comparisons across race/ethnicity, 51 of which evaluated interpersonal violence. In IRR terms, there was little consistent evidence that policies produced significantly different effects for different racial/ethnic groups. However, because of different baseline homicide rates, similar relative effects for some policies (e.g., universal background checks) translated into significantly greater absolute differences in homicide rates among Black compared to white victims.

Conclusions

The current literature does not support strong conclusions about whether state firearm policies differentially benefit or harm particular racial/ethnic groups. This largely reflects limited attention to these questions in the literature and challenges with detecting such effects given existing data availability and statistical power. Findings also emphasize the need for additional rigorous research that adopts a more explicit focus on testing for racial differences in firearm policy effects and that assesses the quality of race/ethnicity information in firearm injury and crime datasets.

A Public Health Crisis Decades in the Making: A Review of 2019 CDC Gun Mortality Data

Gun violence is an American public health crisis decades in the making. The latest Centers for Disease Control and Prevention (CDC) data show that 39,707 people, 86% of whom were male, lost their lives to gun violence in 2019. Gun death data are the most reliable type of gun violence data currently available -- but gun deaths are only the tip of the iceberg of gun violence. With this report, it is our mission to share the most accurate and up-to-date data related to gun deaths while we advocate for more and better data related to gun violence in all its forms. Ultimately, we strive to apply these data to create and implement life-saving policies and programs that will end the gun violence epidemic

When Guns Threaten the Public Sphere: A New Account of Public Safety Regulation Under Heller

Government regulates guns, it is widely assumed, because of the death and injuries guns can inflict. This standard account is radically incomplete—and in ways that dramatically skew constitutional analysis of gun rights. As we show in an account of the armed protesters who invaded the Michigan legislature in 2020, guns can be used not only to injure but also to intimidate. The government must regulate guns to prevent physical injuries and weapons threats in order to protect public safety and the public sphere on which a constitutional democracy depends.

For centuries the Anglo-American common law has regulated weapons not only to keep members of the polity free from physical harm, but also to enable government to protect their liberties against weapons threats and to preserve public peace and order. We show that this regulatory tradition grounds the understanding of the Second Amendment set forth in District of Columbia v. Heller, where Justice Antonin Scalia specifically invokes it as a basis for reasoning about government’s authority to regulate the right Heller recognized.

Today, a growing number of judges and Justices are ready to expand gun rights beyond Heller’s paradigmatic scene: a law-abiding citizen in his home defending his family from a criminal invader. But expanding gun rights beyond the home and into the public sphere presents questions concerning valued liberties and activities of other law-abiding citizens. Americans are increasingly wielding guns in public spaces, roused by persons they politically oppose or public decisions with which they disagree. This changing paradigm of gun use has been enabled by changes in the law and practice of public carry. As courts consider whether and how to extend constitutional protection to these changed practices of public carry, it is crucial that they adhere to the portions of Justice Scalia’s Heller decision that recognize government’s

“longstanding” interest in regulating weapons in public places.

We show how government’s interest in protecting public safety has evolved with changing forms of constitutional community and of weapons threats. And we show how this more robust understanding of public safety bears on a variety of weapons regulations both inside and outside of courts—in constitutional litigation, in enacting legislation, and in ensuring the evenhanded enforcement of gun laws. Recognizing that government regulates guns to prevent social as well as physical harms is a critical first step in building a constitutional democracy where citizens have equal claims to security and to the exercise of liberties, whether or not they are armed and however they may differ by race, sex, or viewpoint.

U.S, Youth Attitudes on Guns

Since 2020, guns have been the leading cause of death in the United States for children and teens. While the proliferation of gun access and gun violence often dominate national, state and local headlines, little has been done to understand the views young people have on these pervasive issues.

To address this gap, Everytown for Gun Safety Support Fund, the Polarization & Extremism Research & Innovation Lab (PERIL) and SPLC came together to study young people’s access to guns, experiences with gun violence, feelings of safety and mental wellbeing, as well as their views on male supremacy, racial resentment and the Second Amendment.

Our U.S. Youth Attitudes on Guns Report provides groundbreaking insights into young people's perceptions, fears and proximity to guns and gun violence. This nationally representative survey of 4,156 Americans aged 14 to 30 and qualitative focus groups lay bare the ubiquity of guns and gun violence in the lives of young Americans.

Association between race, shooting hot spots, and the surge in gun violence during the COVID-19 pandemic in Philadelphia, New York and Los Angeles

Gun violence rates increased in U.S. cities in 2020 and into 2021. Gun violence rates in U.S. cities is typically concentrated in racially segregated neighborhoods with higher poverty levels. However, poverty levels and demographics alone do not explain the high concentration of violence or its relative change over time. In this paper, we examine the extent to which the increase in shooting victimization in Philadelphia, New York, and Los Angeles during the 2020-2021 pandemic was concentrated in gun violence hot spots, and how the increase impacted race and ethnic disparities in shooting victimization rates. We find that 36% (Philadelphia), 47% (New York), and 55% (Los Angeles) of the increase in shootings observed during the period 2020-2021 occurred in the top decile of census block groups, by aggregate number of shootings, and that the race/ethnicity of victims in these gun violence hot spots were disproportionately Black and Hispanic. We discuss the implications of these findings as they relate to racial disparities in victimization and place-based efforts to reduce gun violence.

Firearm purchasing and firearm violence during the coronavirus pandemic in the United States: a cross-sectional study

Background: Firearm violence is a significant public health problem in the United States. A surge in firearm purchasing following the onset of the coronavirus pandemic may have contributed to an increase in firearm violence. We sought to estimate the state-level association between firearm purchasing and interpersonal firearm violence during the pandemic. Methods: Cross-sectional study of the 48 contiguous states and the District of Columbia from January 2018 through July 2020. Data were obtained from the National Instant Criminal Background Check System (a proxy for firearm purchasing) and the Gun Violence Archive. Using negative binomial regression models, we estimated the association between cumulative excess firearm purchases in March through July 2020 (measured as the difference between observed rates and those expected from autoregressive integrated moving average models) and injuries (including nonfatal and fatal) from intentional, interpersonal firearm violence (non-domestic and domestic violence). Results: We estimated that there were 4.3 million excess firearm purchases nationally from March through July 2020 and a total of 4075 more firearm injuries than expected from April through July. We found no relationship between state-level excess purchasing and non-domestic firearm violence, e.g., each excess purchase per 100 population was associated with a rate ratio (RR) of firearm injury from non-domestic violence of 0.76 (95% CI: 0.50– 1.02) in April; 0.99 (95% CI: 0.72–1.25) in May; 1.10 (95% CI: 0.93–1.32) in June; and 0.98 (95% CI: 0.85–1.12) in July. Excess firearm purchasing within states was associated with an increase in firearm injuries from domestic violence in April (RR: 2.60; 95% CI: 1.32–5.93) and May (RR: 1.79; 95% CI: 1.19–2.91), though estimates were sensitive to model specification. Conclusions: Nationwide, firearm purchasing and firearm violence increased substantially during the first months of the coronavirus pandemic. At the state level, the magnitude of the increase in purchasing was not associated with the magnitude of the increase in firearm violence. Increases in purchasing may have contributed to additional firearm injuries from domestic violence in April and May. Results suggest much of the rise in firearm violence during our study period was attributable to other factors, indicating a need for additional research.

Building community resilience to prevent and mitigate community impact of gun violence: conceptual framework and intervention design

Introduction The USA has the highest rate of community gun violence of any developed democracy. There is an urgent need to develop feasible, scalable and community-led interventions that mitigate incident gun violence and its associated health impacts. Our community-academic research team received National Institutes of Health funding to design a community-led intervention that mitigates the health impacts of living in communities with high rates of gun violence. Methods and analysis We adapted ‘Building Resilience to Disasters’, a conceptual framework for natural disaster preparedness, to guide actions of multiple sectors and the broader community to respond to the man-made disaster of gun violence. Using this framework, we will identify existing community assets to be building blocks of future community-led interventions. To identify existing community assets, we will conduct social network and spatial analyses of the gun violence episodes in our community and use these analyses to identify people and neighbourhood blocks that have been successful in avoiding gun violence. We will conduct qualitative interviews among a sample of individuals in the network that have avoided violence (n=45) and those living or working on blocks that have not been a location of victimisation (n=45) to identify existing assets. Lastly, we will use community-based system dynamics modelling processes to create a computer simulation of the community-level contributors and mitigators of the effects of gun violence that incorporates local population-based based data for calibration. Shooting at Sandy Hook Elementary School

In January, 2013, the Office of the Child Advocate was directed by the Connecticut Child Fatality Review Panel to prepare a report that would focus on Adam Lanza (hereinafter referred to as AL), and include a review of the circumstances that pre-dated his commission of mass murder at Sandy Hook Elementary School. The charge was to develop any recommendations for public health system improvement that emanated from the review. Authors of this report focused on AL’s developmental, educational, and mental health profile over time, the services he received from various community providers, and ultimately his condition prior to his actions on December 14, 2012. Authors looked for any warning signs, red flags, or other lessons that could be learned from a review of AL’s life. It was not the primary purpose of this investigation to explicitly examine the role of guns in the Sandy Hook shootings. However, the conclusion cannot be avoided that access to guns is relevant to an examination of ways to improve the public health. Access to assault weapons with high capacity magazines did play a major role in this and other mass shootings in recent history. Our emphasis on AL’s developmental trajectory and issues of mental illness should not be understood to mean that these issues were considered more important than access to these weapons or that we do not consider such access to be a critical public health issue.

Prior Knowledge of Potential School-Based Violence: Information Students Learn May Prevent a Targeted Attack

In the wake of several high-profile shootings at schools in the United States, most notably the shootings that occurred at Columbine High School on April 20, 1999, the United States Secret Service (Secret Service) and the United States Department of Education (ED) embarked on a collaborative endeavor to study incidents of planned (or "targeted") violence in the nation's schools. Initiated in 1999, the study, termed the Safe School Initiative (SSI), examined several issues, most notably whether past school-based attacks were planned, and what could be done to prevent future attacks. The SSI findings highlight that in most targeted school-based attacks, individuals, referred to as "bystanders" in this report, had some type of advanced knowledge about planned school violence. Despite this advanced knowledge, the attacks still occurred. This study aimed to further the prevention of targeted school-based attacks by exploring how students with prior knowledge of attacks made decisions regarding what steps, if any, to take after learning the information. The study sought to identify what might be done to encourage more students to share information they learn about potential targeted school-based violence with one or more adults. Six key findings were identified. Given the small sample size and the exploratory nature of the study, generalization from these findings may be limited. The findings are: (1) The relationships between the bystanders and the attackers, as well as when and how the bystanders came upon information about the planned attacks, varied; (2) Bystanders shared information related to a threat along a continuum that ranged from bystanders who took no action to those who actively conveyed the information; (3) School climate affected whether bystanders came forward with information related to the threats; (4) Some bystanders disbelieved that the attacks would occur and thus did not report them; (5) Bystanders often misjudged the likelihood and immediacy of the planned attack; and (6) In some situations, parents and parental figures influenced whether the bystander reported the information related to the potential attack to school staff or other adults in positions of authority,

Final Report of the Federal Commission on School Safety

Communities across the country are responding to school violence with a number of measures, including assigned school resource officers (SRO). School administrations, law enforcement agencies, families, and community stakeholders are diligently working to protect children and education personnel from school attacks. The National Police Foundation (NPF), in collaboration with the COPS Office, created the Averted School Violence (ASV) database in 2015 as a platform for law enforcement, school staff, and mental health professionals to share information about ASV incidents and lessons learned with the goal of mitigating and ultimately preventing future injuries and fatalities in educational institutions. The database includes school incidents beginning with the Columbine High School attack (1999) and continuing to the present day. The NPF has partnered with stakeholder groups National Association of School Resource Officers (NASRO) and the International Association of Campus Law Enforcement Administrators (IACLEA) to conduct research and analysis on improving school safety. This report examines a dozen case studies of targeted violence incidents thwarted by the positive and often heroic actions of classmates, school administrators, SROs, and law enforcement agencies. It also includes recommendations and lessons learned from all cases in the ASV database. In addition, a companion publication entitled Targeted Violence Averted: College and University Case Studies presents information on post-secondary averted violence incidents and lessons learned to support student safety.

School Resource Officers: Averted School Violence Special Report

Tuesday, April 20, 1999, was sadly the last day of school for the seniors of Columbine High School in Littleton, Colorado. On that day, two 12th-grade students armed with a semiautomatic pistol, two shotguns, and a rifle murdered a teacher and 12 of their fellow students; an additional 21 people were injured by gunfire, and three were injured escaping from the school. The perpetrators took their own lives in the school library where they had killed most of their victims. At the beginning of the attack, one of the shooters exchanged gunfire outside with the school resource officer (SRO). While the Columbine shooting inarguably contributed to the expanded deployment of SROs in schools, it was not the advent of school-based law enforcement in the United States. There are indications in the research literature that Flint, Michigan, assigned a police officer to its schools in 1953, and the Fresno (California) Police Department first assigned plainclothes officers to its elementary and middle schools in 1968 (West and Fries 1995). The Fresno initiative was an attempt to enhance police-community relations specifically with youth. The federal impetus for increasing the number of SROs can be traced in part to the Violent Crime Control and Law Enforcement Act of 1994 as well as the Gun-Free Schools Act of 1994. The Cops in School program, funded by the U.S. Department of Justice Office of Community Oriented Policing Services (COPS Office), grew out of the former statute. The latter statute was enacted in response to juvenile and gang violence. Soon after the tragedy at Columbine, which at the time was the worst mass casualty shooting at a school in the United States, the U.S. Department of Education (DoED) and the U.S. Secret Service undertook a study of past school shootings to identify factors that might help prevent future targeted school attacks (Vossekuil et al. 2004). The key recommendation from that study was that all schools should establish behavior threat assessment teams. The report recommended that school administrators, law enforcement officers (especially SROs), teachers, and counselors participate in these teams to address concerning behavior by members of the school community.
