Sustainable Reintegration: Strategies to Support Migrants Returning to Mexico and Central America

As U.S. deportations to Mexico continue at substantial levels and the numbers returned by both the U.S. and Mexican governments to El Salvador, Guatemala, and Honduras are increasing, it has become more urgent for countries in the region to develop successful reception and reintegration programs that meet the diverse needs of returning migrants.

Between fiscal years 2012-18, the United States carried out approximately 1.8 million repatriations of Mexican migrants, and the United States and Mexico together accomplished 1.4 million returns of migrants from the three Northern Triangle countries.

Drawing on fieldwork and interviews with government officials, researchers, representatives of civil-society and international organizations, as well as returning migrants, this report highlights promising reintegration strategies and pressing challenges. Mexico and the three Northern Triangle countries exhibit different levels of capacity and degrees of implementation in their reception and reintegration programs. While most deported migrants now receive basic reception services, their access to reintegration services is somewhat more mixed. Among the challenges: Difficulty obtaining the official ID that allows returning migrants to access these services, limited awareness and geographic distribution of services, difficulty matching returning migrants’ skills with labor-market needs, and barriers to reintegration posed by social stigmatization and employment discrimination.

The report offers a range of recommendations to governments and others, including: Prepare migrants for reintegration prior to their return, even before deportation; issue primary ID documents from abroad or upon reception; and ensure reintegration services tap into returning migrants' cultural roots. Improving reception and reintegration services represents a long-term investment for both destination and origin countries, the authors conclude, holding the potential to reduce re-migration while enabling countries of origin to benefit from the skills and assets migrants have acquired abroad.

Laying the Foundation for Regional Cooperation: Migration Policy & Institutional Capacity in Mexico and Central America

The region that stretches from Panama northward to the United States is a major corridor for unauthorized migration. In recent years, most people on the move have come from Guatemala, Honduras, and, to a lesser extent, El Salvador. But there has also been an increasing number of migrants from outside the region who pass through Central America on their way to the U.S.-Mexico border. Amid these changing migration patterns, countries in this region have an unprecedented opportunity to work together to lay the foundation for a regional migration system that privileges safe, orderly, and legal movement.A critical first step to capitalizing on this opportunity is understanding these countries’ institutional capacities, legal frameworks, and migration and asylum policies. This report takes stock of these elements of migration-management systems in Mexico and Central America, drawing insights in part from interviews with more than 75 policymakers, civil-society leaders, and other stakeholders.

In recent years, the analysis finds, Mexico and Costa Rica have taken steps to leverage their existing migration institutions to improve operational capacity, though notable challenges remain. Meanwhile, El Salvador, Guatemala, Honduras, and Panama are at earlier stages in this process. Across the region, international organizations play an important role in supporting these efforts, while civil society is vital to expanding migrants’ access to protection mechanisms and reintegration supports. Among the major areas the report identifies as important for capacity-building efforts are: developing clear migration policymaking processes; professionalizing border and immigration enforcement efforts, with an emphasis on transparency and sensitivity to the circumstances of families, children, and other vulnerable migrants; and investing in asylum systems, protection mechanisms for people displaced within countries, and reintegration programs for returning migrants. Such efforts, the authors note, would not only help governments in the region more effectively address current migration issues, they also promise to better equip them to proactively respond to future challenges.

INTRODUCTION The illegal migration crisis at the U.S. southern border presents a grave security threat to the United States and a humanitarian catastrophe for the vulnerable people involved. Illegal migration to the United States has reached astronomical levels since the Biden Administration entered office in January 2021.1 The sheer number of illegal migrants, combined with the evolving tactics that transnational criminal organizations (TCOs) employ to smuggle and traffic individuals, presents an untenable security and humanitarian situation. Weak U.S. border security and enforcement of immigration laws undermines U.S. efforts to improve the rule of law and humanitarian conditions in the region, takes a mental and physical toll on U.S. law enforcement personnel, and challenges their ability to defend our nation’s borders. The prevailing conditions benefit dangerous criminals and expose vulnerable populations to unspeakable dangers and abuse. The Biden Administration’s failure to secure our nation’s borders is worsening this crisis. Further, it undermines efforts to address inadequate law enforcement as well as asylum processing policies and capabilities in Mexico and the northern Central American countries of El Salvador, Guatemala, and Honduras. This report puts forward concrete ideas to: • Establish effective migration controls in the United States; • Strengthen border security and migration management capacities in the region; and • Target TCOs smuggling and trafficking migrants.

Shelter from the Storm: Better Options for New York City’s Asylum-Seeker Crisis

Since the summer of 2022, more than 70,000 asylum seekers have arrived in New York City, stretching public resources to their limit. The massive influx has been particularly challenging given the city’s “right to shelter,” the result of a 1979 lawsuit, Callahan v. Carey, and corresponding consent decree, which required the city to provide immediate shelter to those who request it, regardless of the number of applicants or the availability of resources. In order to comply with this requirement, the city has housed some 40,000 migrants in shelters—which has led to an approximately 70% spike in the shelter population in a single year. NYC is currently supporting more than 170 emergency shelters and 10 additional large-scale humanitarian relief centers. Shelters and relief centers simply cannot house all the newly arrived migrants, which has forced the city to procure approximately 4,500 hotel rooms in unionized facilities, often through expensive contracts …

Migrants in transit through Mexico to the US: Experiences with violence and related factors, 2009-2015

Objectives: The objectives of the study are to 1) estimate the burden of physical, sexual, and psychological violence among migrants in transit through Mexico to the US; and 2) examine the associations between experiencing violence and sociodemographic characteristics, migratory background, and health status in this vulnerable population.

Results: The overall prevalence of suffering from any form of violence was 29.4%. Nearly 24% reported physical violence, 19.5% experienced psychological violence, and approximately 2% reported sexual violence. TTTs experienced a significantly greater burden of violence compared to men and women. Violence occurred more frequently among migrants from Central America (30.6%) and other countries (40.0%) than it did among Mexican migrants (20.5%). Experiences involving sexual, physical and psychological violence as well as theft and even kidnapping were described by interviewees. Migrants mistrust the police, migration authorities, and armed forces, and therefore commonly refrain from revealing their experiences.

Conclusion: Migrants are subjected to a high level of violence while in transit to the US. Those traveling under irregular migratory conditions are targets of even greater violence, a condition exacerbated by gender inequality. Migrants transiting through Mexico from Central American and other countries undergo violence more frequently than do Mexican migrants. Protective measures are urgently needed to ensure the human rights of these populations.

Representations of Transnational Human Trafficking: Present-day News Media, True Crime, and Fiction

This open access edited collection examines representations of human trafficking in media ranging from British and Serbian newspapers, British and Scandinavian crime novels, and a documentary series, and questions the extent to which these portrayals reflect the realities of trafficking. It tackles the problematic tendency to under-report particular types of victim and forms of trafficking, and seeks to explore both dominant and marginalised points of view. The authors take a cross-disciplinary approach, utilising analytical tools from across the humanities and social sciences, including linguistics, literary and media studies, and cultural criminology. It will appeal to students, academics and policy-makers with an interest in human trafficking and its depiction in the modern day.

Regularisations of Irregularly Staying Migrants in the EU: A Comparative Legal Analysis of Austria, Germany and Spain

‘Combatting’ irregular migration is one of the key challenges to migration management at EU level. The present book addresses one of the most pressing structural problems regarding the EU’s return policy: the low return rate of irregularly staying migrants. In this regard the EU Return Directive obliges Member States to issue a return decision, yet only 40% of such decisions are enforced annually. Moreover, despite the political and legal efforts, the EU is not making any significant progress in enforcing the rules it has laid down in the Return Directive. The legislation of EU Member States may, however, serve as a source for possible solutions to ‘combat’ the problem of irregularly staying migrants. This is why the book compares the system of regularisations in Austria, Germany and Spain. Regularisations constitute an effective alternative to returns because they terminate the irregular residence of migrants, not through deportation, but rather by granting a right of residence. Regularisation is therefore understood as each legal decision that awards legal residency to irregularly staying migrants. As is shown by the examination and comparison of regularisations in Austria, Germany and Spain, differentiated systems of regularisation exist at national level. However, EU regularisations supplementing the present return policy would be more effective at ‘combatting’ irregular migration at EU level.

Most notably, on May 13, Mayor Eric Adams announced that the historic 1,025-room Roosevelt Hotel, located in the heart of Midtown East, would become New York City’s central migrant intake center,[2] at a reported cost of $225 million.[3] In addition to hosting hundreds of families and individuals on-site, the location will process all arriving asylum seekers and provide them with a range of city services, including government-issued ID cards, public-school and health-insurance enrollment, mental-health counseling, and more.

Biden's Immigration Parole Programs Are Working

The Biden administration’s parole programs are successfully reducing both illegal immigration and total immigration into the U.S., and they are shifting the composition of immigrants so that they are more self-sufficient and reliant on their existing social networks, rather than dependent on government assistance. Maintaining and improving parole will be even more important now that Title 42 has expired and the U.S. government has lost another tool for reducing illegal immigration. The parole program for migrants from Venezuela began in October 2022 and expanded to Cuba, Haiti, and Nicaragua in January 2023. Approximately 102,000 people were paroled into the U.S. from Cuba, Haiti, Nicaragua, and Venezuela (CHNV) from October 2022 until April 2023, the most recent numbers available. Through March 2023, the program has prevented the entry of more than 380,000 illegal immigrants into the United States. Without the CHNV program, these migrants would have otherwise been processed under Title 8 immigration law and likely admitted into the country. Potential illegal immigrants wait in their home countries instead of crossing the southern border, since this parole program requires that migrants have a U.S. sponsor, obtain a passport, and pass security and health vetting. This high barrier to entry successfully reduces total immigration and shifts the composition of immigrants toward those who can more easily support themselves or rely on their social and family networks rather than on government welfare.

Still at Risk: The Urgent Need to Address Immigration Enforcement’s Harms to Children

Over two decades, immigration enforcement in the country’s interior has separated families and caused lasting damage to children in immigrant families and communities. These policies, resulting in worksite raids, arrests, and deportations, have undermined the health and well-being of more than 5 million children with at least one undocumented parent. In the meantime, Congress has failed to enact meaningful immigration reform that centers the dignity and humanity of immigrant families. Long-standing community members continue to suffer.

A new report from CLASP and UnidosUS analyzes trends in interior enforcement and documents the negative impact on children’s economic security, access to food, housing stability, mental health, and educational outcomes.  Although there has been a downward trend in interior enforcement actions since 2009, harmful policies remain in place and more humane policies–such as the DACA program, parental interest directive, and protected areas policy–remain stalled in the courts or face implementation challenges.

Multiple Perspectives on Immigrant and Crime Relationship

The association between immigration and crime has been the center of debates not only in the field of criminology but also in political arguments. However, consistent findings in empirical research show a null association or even crime reduction effects of immigration. To fill the gap in the literature and provide a more comprehensive understanding, this dissertation examines the immigration and crime nexus at multiple dimensions: individual, perceptual, and structural. Using data from various sources, the results of three studies note four important findings: (1) immigration/immigrant status holds a negative association with crime, (2) immigrants are different from non-immigrant residents regarding antisocial attitudes, presenting more favorable attitudes toward criminal behavior, (3) theoretical frameworks of the revitalization perspective and rational choice theory work in explaining lower levels of crime within immigrant groups or communities, and (4) cultural and environmental contexts matter to account for immigration and crime nexus. Implications, limitations, and suggestions for future research are also discussed in the study.

The Unintended Consequences of US immigration Enforcement Policies

US immigration enforcement policy seeks to change the behaviors and views of not only individuals in the United States but also those of prospective migrants outside the United States. Yet we still know relatively little about the behavioral and attitudinal effects of US enforcement policy on the population abroad. Thisstudy uses a randomized experiment embedded in a nationally representative survey that was administered in El Salvador,Guatemala, Honduras, and Mexico to analyze the effects of USdeterrence policies on individuals migration intentions and their attitudes toward the US immigration system. The two policies that the current study examines are immigration detention and nonju-dicial removals. The survey results provide no evidence that a heightened awareness of these US immigration enforcement pol-icies affects individuals intentions to migrate to the United States.But heightened awareness about the widespread use of immigra-tion detention in the United States does negatively impact indi-viduals’assessments about the procedural and outcome fairness of the US immigration system. These findings suggest that immi-gration detention may foster delegitimating beliefs about the USlegal system without producing the intended deterrent

Understanding Immigration Detention: Causes, Conditions, and Consequences

During the summer of 2018, the US government detained thousands of migrant parents and their separated children pursuant to its zero-tolerance policy at the United States–Mexico border. The ensuing media storm generated unprecedented public awareness about immigration detention. The recency of this public attention belies a long-standing immigration enforcement practice that has generated a growing body of research in the past couple of decades. I take stock of this research, focusing on the causes, conditions, and consequences of immigration detention in the United States. I also discuss critical tasks for future research, including (a) examining the role of local governments, the private prison industry, and decision makers responsible for release decisions in maintaining the detention system; (b) extending the field of inquiry to less-visible detainee populations and detention facility guards and staff, for a fuller understanding of detention conditions; and (c) investigating not only direct but also indirect consequences of detention.

Venezuelan Migrants and Refugees in Latin American and the Caribbean: A Regional Profile

More than 5 million Venezuelans have left their country due to the ongoing political and economic crises there. More than 4 million of these refugees and migrants have moved to other countries in Latin America and the Caribbean. This has challenged receiving-country governments to rapidly rethink their policies for admitting and granting status to newcomers, and to consider how to adapt education, health-care, and other systems to support both migrants and the communities in which they settle. The COVID-19 pandemic that hit the region in early 2020 has added a further layer of complexity, as well as new risks for people on the move.

This fact sheet presents a profile of refugees and migrants travelling across 11 Latin American and Caribbean countries in 2019—Argentina, Brazil, Chile, Colombia, Costa Rica, Ecuador, Guyana, Paraguay, Peru, Trinidad and Tobago, and Uruguay. The data analyzed come from the Displacement Tracking Matrix (DTM), through which the International Organization for Migration (IOM) collects information about refugee and migrant demographic characteristics, labor market participation, trip details, difficulties encountered while travelling, and more.
