Firearm Violence: A Public Health Crisis in America

From the document: "A recent nationally representative survey (n=1,271) found that the majority of U.S. adults or their family members (54%) have experienced a firearm-related incident. Among all respondents, 21% have personally been threatened with a firearm, 19% have a family member who was killed by a firearm (including by suicide), 17% have witnessed someone being shot, 4% have shot a firearm in self-defense, and 4% have been injured by a firearm (Figure 2). 'Nearly 6 in 10 U.S. adults say that they worry 'sometimes,' 'almost every day,' or 'every day,' about a loved one being a victim of firearm violence.' Such high levels of exposure to firearm violence for both children and adults give rise to a cycle of trauma and fear within our communities, contributing to the nation's mental health crisis. This Advisory describes the public health crisis of firearm violence in America and describes strategies for firearm injury and violence prevention, with a focus on the health and well-being of children, families, and communities."

Extreme risk protection orders, race/ethnicity, and equity: Evidence from California

Extreme risk protection orders (ERPOs) provide a civil mechanism to temporarily remove firearm access from individuals at high risk of harming themselves or others. Evidence and theory suggest that ERPOs can prevent firearm-related harm, but the policy's impact on racial/ethnic equity is largely unknown. To examine potential inequities by race/ethnicity in public perceptions and use of California's ERPO law, we drew on two complementary data sources: 1) a 2020 state-representative survey of California adults, and 2) ERPO court documents for the first 3 years of policy implementation (2016-2018). Majorities (54-89%) of all racial/ethnic groups reported that ERPOs are at least sometimes appropriate, and 64-94% were willing to ask a judge for an ERPO for a family member. However, Black and Hispanic/Latinx survey participants less often perceived ERPOs as appropriate and were less willing to serve as petitioners, with Black participants citing lack of knowledge about ERPOs and not trusting the system to be fair as their top reasons for unwillingness. Similarly, review of ERPO court documents revealed that no family or household members served as petitioners for Black and Hispanic/Latinx ERPO respondents. Additionally, Black respondents were the least likely to have documented access to a firearm and legal representation in court. Racial/ethnic equity in ERPO use may be improved by reducing barriers to petitioning, incorporating non-law enforcement intervention professionals like behavioral health specialists into the ERPO process, providing legal assistance to respondents and petitioners, and investing in the social safety net.

The Contours of the Gun Industry Impunity: Separation of Powers, Federalism, and the Second Amendment

In 2005, Congress passed the Protection of Lawful Commerce in Arms Act (PLCAA), granting the firearms industry sweeping immunity from civil lawsuits. However, PLCAA immunity is not absolute. This Article demonstrates that both state and federal courts have fundamentally misread PLCAA when adjudicating cases involving the scope of gun industry immunity. Properly understood, PLCAA permits lawsuits against the gun industry so long as they are based on statutory causes of action rather than common law. While broadly preempting state common law claims, PLCAA affords state legislatures autonomy in deciding how to regulate the gun industry within their borders.

Additionally, this Article addresses unresolved questions concerning constitutional limits on gun industry regulation. PLCAA explicitly strikes a balance between three constitutional principles. It safeguards the individual right to keep and bear arms by protecting the gun industry from civil litigation that would unduly curtail civilian access to firearms. It insists that the separation of powers requires that gun industry regulation should derive from legislation not common law adjudication. It affords state governments autonomy in deciding how to regulate the gun industry, recognizing that there are regional differences in attitudes about how to best reduce firearms-related violence. We counsel against interpretations of the Second Amendment’s application to gun industry regulation that would expand the right to keep and bear arms at the expense of other important constitutional principles such as the separation of powers and federalism

Washington State Assault Weapon Firearm Violence Before and After Firearm Legislation Reform

Background

In January of 2019, Washington State (WA) passed Initiative 1639 making it illegal for persons <21 years-old to buy assault weapons (AWs). This study aimed to evaluate the effects of WA-1639 on firearm-related incidents involving AWs by those <21 years-old in WA, hypothesizing a decrease in incidents after WA-1639.

Methods

Retrospective (2016-2021) data on firearm violence (FV) events were gathered from the Gun Violence Archive. The rate of FV was weighted per 100,000 people. Total monthly incidents, injuries, and deaths were compared pre-law (January 2016-December 2018) vs post-law (January 2019-December 2021) implementation. Mann-Whitney U tests and Poisson’s regression were used for analysis.

Results

From 4091 FV incidents (2210 (54.02%) pre-law vs 1881 (45.98%) post-law), 50 involved AWs pre- (2.3%) and 15 (.8%) post-law. Of these, 11 were committed by subjects <21 years-old pre-law and only one occurred post-law. Total incidents of FV (z = −3.80, P < .001), AW incidents (z = −4.28, P < .001), and AW incidents involving someone <21 years-old (z = −3.01, P < .01) decreased post-law. Additionally, regression analysis demonstrated the incident rate ratio (IRR) of all FV (1.23, 95% CI [1.10-1.38], P < .001), all AW FV incidents (3.42, 95% CI [1.70-6.89], P = .001), and AW incidents by subjects <21 years-old (11.53, 95% CI [1.52-87.26], P = .02) were greater pre-law vs post-law.

Discussion

Following implementation of WA-1639, there was a significant decrease in FV incidents and those involving AWs by individuals <21 years-old. This suggests targeted firearm legislation may help curtail FV. Further studies evaluating FV after legislation implementation in other states is needed to confirm these findings.

IED-building networks have established material and training links across conflict areas in West and Central Africa, and their designs have remained constant and inexpensive throughout the region—helping to increase their use in attacks against domestic and international security forces, UN peacekeepers, and civilians.

Out of Control: The Trafficking of Improvised Explosive Device Components and Commercial Explosives in West Africa—a new report from the Small Arms Survey’s Improvised Explosive Devices (IEDs) in West Africa project—analyses data from more than 2,200 IED-related incidents between March 2013 and September 2022, and stresses the importance of coordinated regional approaches in eliminating illegal IED use in West and Central Africa.

We assess firearms as a means of Black self-defense in the Jim Crow South. We infer firearm access by race and place by measuring the fraction of suicides committed with a firearm. Corroborating anecdotal accounts and historical claims, state bans on pistols and increases in White law enforcement personnel served as mechanisms to disarm the Black community, while having no comparable effect on White firearms. The interaction of these mechanisms with changing national market prices for firearms provides us with a credible identification strategy for Black firearm access. Rates of Black lynching decreased with greater Black firearm access.

Victims, offenders and victim-offender overlaps of knife crime: A social network analysis approach using police records

Knife crime is a source of concern for the police in England and Wales, however little published research exists on this crime type. Who are the offenders who use knives to commit crime, when and why? Who are their victims, and is there a victim-offender overlap? What is the social network formation for people who are exposed to knife crime? Using a multidimensional approach, our aim is to answer these questions about one of England and Wales’ largest jurisdictions: Thames Valley. We first provide a state-of-the-art narrative review of the knife crime literature, followed by an analysis of population-level data on central tendency and dispersion of knife crimes reported to the police (2015–2019), on offences, offenders, victims, victim-offender overlaps and gang-related assaults. Social network analysis was used to explore the formations of offender-victim networks. Our findings show that knife crime represents a small proportion of crime (1.86%) and is associated largely with violence offenses. 16–34 year-old white males are at greatest risk of being the victims, offenders or victim-offenders of knife crime, with similar relative risks between these three categories. Both knife offenders and victims are likely to have a criminal record. Knife crimes are usually not gang-related (less than 20%), and experienced mostly between strangers, with the altercation often a non-retaliatory ‘one-off event’. Even gang-related knife crimes do not follow ‘tit-for-tat’ relationships—except when the individuals involved have extensive offending histories and then are likely to retaliate instantaneously. We conclude that while rare, an incident of knife crime remains predictable, as a substantial ratio of offenders and victims of future knife crime can be found in police records. Prevention strategies should not be focused on gang-related criminals, but on either prolific violent offenders or repeat victims who are known to the police—and therefore more susceptible to knife crime exposure.

Knife crime offender characteristics and interventions – A systematic review

Knives and sharp objects are tools used in a wide range of violent offences. However, knife offending may have different risk factors than general violence, thus requiring tailored interventions. This systematic review aims to synthesise evidence on the characteristics of knife offenders and interventions aimed at the reduction of knife crime. After screening 1352 titles and abstracts, 344 articles were fully considered of which 21 papers met the inclusion criteria and were quality assessed. These consisted of 15 offender characteristic studies and six intervention studies. Findings suggested that knife crime may be associated with illicit drug use, exposure to any violence as a witness, victim or perpetrator and mental health problems. Males were more at risk of engaging in knife crime in the community and females in domestic settings. Different risk factors were found between gang involved and non-involved knife offenders. Primary prevention strategies, such as stop and search, knife amnesties, media campaigns and curfews did not show a significant impact in reducing knife crime. By contrast, increasing offenders' access to tailored support regarding housing, education, and employment showed an impact in reducing weapon carrying. Further research is required in the area to support the reliability of outcomes.

Knife Crime Education Programmes Toolkit technical report

This technical report reviews the evidence on the effect of knife crime education interventions on the involvement of children and young people in crime and violence. This report is based primarily on a recent systematic review by Browne et al. (2022). Knife crime education interventions are implemented with children and young people in order to raise awareness of the legal implications of knife carrying as well as the physical and emotional implications. These interventions also aim to change attitudes about knife carrying and use in order to prevent and reduce the involvement of children and young people in crime and violence. Key components of these interventions include the delivery of educational sessions with groups of children and young people, the provision of workshops, and group discussions. Knife crime education interventions may adopt a ‘norms approach’, where the intervention content focuses on challenging children and young people’s perceptions that it is ‘normal’ to carry a knife. Other types of interventions to reduce knife crime, in particular media campaigns, have used real life stories to illustrate the profound impacts and consequences of carrying knives. For example, in 2017 the #knifefree campaign by the Home Office (2017) used stories from young people who had made the decision to not carry a knife. Knife crime education interventions would typically be implemented in settings where children and young people attend or gather, for example, schools or community centres. They could also be implemented in hospitals or Youth Offender Institutions. Interventions can be implemented by a range of personnel, including nurses working in emergency medicine (England & Jackson, 2013) or NonGovernment Organisations (Gilbert & Sinclair, 2019). The presumed causal mechanisms in knife crime education interventions are that by raising awareness around the impact and/or consequences of knife carrying and knife use for themselves and their friends and family, young people may be deterred. There can also be peer effects, if participants are less accepting of knife carrying by their friends, and by word of mouth to friends and siblings. There may be an adverse effect if the education creates a misperception regarding the prevalence of knife ownership and so encourages participants to carry

Dribs and Drabs: The Mechanics of Small Arms Trafficking from the United States

When one thinks of arms traffickers, the image that often comes to mind is of the stereotypical ‘Merchant of Death’ – ambitious, well-connected, globetrotting entrepreneurs who single-handedly arm warlords and insurgents across the world. While there is some truth to the stereotype, most illicit arms traffickers do not fit this profile. The latest Issue Brief from the Small Arms Survey—Dribs and Drabs: The Mechanics of Small Arms Trafficking from the United States—analyses a side of the arms trade that is less flashy, less centralized, and even more difficult to stop. Using an extensive database compiled from court records, the Issue Brief looks at the modes of transport, concealment methods, and smuggling techniques employed by arms traffickers in the United States, most of whom bear little resemblance to the ‘Merchants of Death’.

This Issue Brief draws on a database that follows the activities of more than 400 individuals accused of illegally shipping small arms and light weapons, their parts, accessories, or ammunition from the US to at least 46 countries. It offers an overview of the types of small arms trafficked and how smugglers evade export controls and border controls. The Brief concludes with a policy-relevant analysis of the implications of these cases.

Gun-Running in Papua New Guinea: From Arrows to Assault Weapons in the Southern Highlands

This field study focuses on PNG's Southern Highlands Province, a conspicuous hot spot for armed violence and gun-related injury. It provides a preliminary tally of illegal high-powered guns in parts of the province seen as particularly vulnerable to armed violence, and documents the profound disruption wrought by their misuse. Tribal fighters, mercenary gunmen, and criminals provide details of their illicit firearms and ammunition, trafficking routes, and prices paid. The most common illegal assault weapon is the Australian-made self-loading rifle, followed by the US-made M16, both of which are sourced primarily from PNG Defence Force stocks. Many of the remainder are AR-15s obtained from the PNG police.
