Murder trends in South Africa’s deadliest provinces

The South African per-capita murder rate has steadily escalated since 2011/12, when it was at its lowest since 1994. The 2022/23 rate of 45 per 100 000 is the highest in 20 years. But focusing on national murder trends is misleading as trends vary greatly across the nine provinces. The current high per-capita murder rate is driven by high rates in the Eastern Cape, KwaZulu-Natal, the Western Cape and Gauteng. Key findings: South African murder trends vary considerably across provinces. The Eastern Cape, KwaZulu-Natal, the Western Cape and Gauteng have the highest per-capita murder rates. In 2022/23, the Eastern Cape had the highest murder rate (71 per 100 000), followed by KwaZulu-Natal and the Western Cape, both with annual murder rates of 56. The four provinces with the most murders have also recorded the highest per-capita murder rate increases in the last 10 years. Since 2011/12, rates have increased most dramatically in KwaZulu-Natal and the Eastern Cape. The increase has been greatest from 2017/18 to 2022/23. The per-capita murder rate in the Western Cape decreased over the last five years. Recommendations The government and society must prioritise reducing murder rates, which are high and increasing. The collection of data about murder, and the analysis thereof, must be improved. ‘One-size-fits-all’ approaches to addressing murder are unlikely to be effective. Responses should be adapted to respond to the drivers of murder focusing on high-murder localities. Priority should be given to understanding and addressing murder in the four provinces with the highest per-capita murder rates. KwaZulu-Natal and, to a lesser degree, Gauteng experienced major surges in murder in 2021/22, with increases continuing in 2022/23. These have taken them well above their rates in the year before the COVID-19 pandemic and national lockdown. Deaths during the July 2021 unrest were not a major contributor to the increases in murder in KwaZulu-Natal and Gauteng in 2021/22. Many experts believe that the entrenchment and growth of organised crime has played a major role in the increasing number of murders. More in-depth provincially focused research and analysis is required to better understand the factors and circumstances driving murder trends.

Migrants and Crime in Sweden in the Twenty-First Century

In 2005, the Swedish Crime Prevention Agency published a report about the link between immigration and crime. Since then, no comprehensive study has been conducted even though Sweden has experienced a large influx of migrants in combination with a rising crime rate. This study conducted by Göran Adamson and Tino Sanandaji is the first purely descriptive scientific investigation on the matter in fifteen years. The investigation (from 2002 to 2017) covers seven distinct categories of crime, and distinguishes between seven regions of origin. Based on 33 percent of the population (2017), 58 percent of those suspect for total crime on reasonable grounds are migrants. Regarding murder, manslaughter and attempted murder, the figures are 73 per cent, while the proportion of robbery is 70 percent. Non-registered migrants are linked to about 13 percent of total crime. Given the fact that this group is small, crime propensity among non-registered migrants is significant.

CCP's Role in the Fentanyl Crisis

The PRC, under the leadership of the Chinese Communist Party (CCP), is the ultimate geographic source of the fentanyl crisis. Companies in China produce nearly all of illicit fentanyl precursors, the key ingredients that drive the global illicit fentanyl trade. The House Select Committee on the Strategic Competition between the United States and the Chinese Communist Party (Select Committee) launched an investigation to better understand the role of the CCP in the fentanyl crisis. This investigation involved delving deep into public PRC websites, analyzing PRC government documents, acquiring over 37,000 unique data points of PRC companies selling narcotics online through web scraping and data analytics, undercover communications with PRC drug trafficking companies, and consultations with experts in the public and private sectors, among other steps. [...] [T]he Select Committee found thousands of PRC companies openly selling [...] illicit materials on the Chinese internet--the most heavily surveilled country-wide network in the world. The CCP runs the most advanced techno-totalitarian state in human history that 'leave[s] criminals with nowhere to hide' and has the means to stop illicit fentanyl materials manufacturers, yet it has failed to pursue flagrant violations of its own laws."

Social Inclusion from Below: The Perspectives of Street Gangs and Their Possible Effects on Declining Homicide Rates in Ecuador

Since 2007, the Ecuadorian approach to crime control has emphasized efforts to reach higher levels of social control based on policies of social inclusion and innovations in criminal justice and police reform. One innovative aspect of this approach was the decision to legalize a number of street gangs in 2007. The government claims the success of these policies can be seen in homicide rates that have fallen from 15.35 per 100,000 in 2011 to 5 per 100,000 in 2017. However, little is understood about the factors and their combination that have produced this outcome. To explore this phenomenon, we developed a research project focusing on the impact of street gangs involved in processes of social inclusion on violence reduction. From April to October 2017, we collected multiple data sets including 60 face-to-face interviews with members from four different street subcultures in several field sites, field observations and archival materials to answer two primary questions: How has the relationship between street groups and state agencies changed in the past 10 years? How has this changed relationship contributed to a hitherto unexamined role in the homicide reduction phenomenon of Ecuador? We found that legalization helped reduce violence and criminality drastically while providing a space, both culturally and legally, to transform the social capital of the gang into effective vehicles of behavioral change. In policy terms, we argue that the social inclusion approach to street gangs should be continued and highlighted as a model of best practices of the state.

Countering Counterfeits: The Real Threat of Fake Products How Fake Products Harm Manufacturers, Consumers and Public Health—and How to Solve This Problem

Amid an unprecedented global health crisis, manufacturers have stepped up and taken the lead, working together and with national, state and local governments to fight the spread of COVID-19. Manufacturers deliver day-to-day necessities, lifesaving medical innovations and products that improve people’s lives in countless ways. While the pandemic has demonstrated anew the importance of American innovation and ingenuity, it has also revealed a serious threat: counterfeit products that put lives and livelihoods at risk. Counterfeiting is not a new problem; it has harmed manufacturers, American workers and consumers for years. But the problem is getting worse, and the COVID-19 pandemic has shown just how dangerous inaction can be. As part of the nation’s critical response effort, manufacturers have been supplying health care workers and other Americans on the front lines of this crisis with vital goods, including personal protective equipment, hospital beds, ventilators, hand sanitizers, cleaning supplies and other critical health care and safety products. But while manufacturing men and women work long hours to ramp up production of desperately needed products to fight the spread of this deadly illness, counterfeiters have exploited the crisis to peddle fake tests, dangerous vaccines and ineffective protective gear. These counterfeits are harming American citizens and hindering manufacturers’ efforts to protect their workers and communities. The prevalence of counterfeits in the COVID-19 response has brought new urgency to this long-simmering issue. So the National Association of Manufacturers is leading the charge against fake and counterfeit goods, bringing together diverse stakeholders and driving innovative policy solutions to address these issues once and for all and to ensure the long-term success of our sector and the safety and security of the people who rely on our products.

The Impact of Organized Retail and Product Theft in the United States

The Retail Industry Leaders Association (RILA) is the US trade association for retailers that have earned leadership status by virtue of their sales volume, innovation, or aspiration. The Buy Safe America Coalition (BSA) represents a diverse group of responsible retailers, consumer groups, manufacturers, intellectual property advocates and law enforcement officials who support efforts at all levels of government to protect consumers and communities from the sale of counterfeit and stolen goods. One important issue facing US retailers is the growth in the availability and sales of illicit products, both from counterfeit imports and from products stolen from legitimate retailers. These products are increasingly sold online through third-party marketplaces. RILA and BSA asked John Dunham & Associates (JDA) to examine the data around these illicit sales to determine how they impact the US economy, federal tax revenues, and criminal activity. This is the second in a series of papers examining the issue of organized retail crime (ORC), and its effect on the United States economy. This analysis will focus on product theft from brick-and- mortar retailers and the rise of organized theft operations that fence illegally obtained goods to consumers, increasingly online. While this paper focuses solely on those goods stolen from retail locations, there is a growing problem with consumer goods being stolen from containers and trucks as the supply chain has backed up in recent months. For the purpose of this analysis, cargo theft was not included. According to the analysis: • As much as $68.9 billion worth of products were stolen from retailers in 2019. This represents about 1.5 percent of total retail sales. • Law enforcement and retail asset protection officials have found that the availability of anonymous online marketplaces has provided an easy way to sell stolen goods, and that the growth of these marketplaces coincides with a recent surge in organized retail crime that puts both employees and customers in harm’s way. • Academic research has suggested that most retail theft represent crimes of opportunity. In other words, people steal when it is easy to do so. Other causes include poor economic conditions, and dissatisfaction among workers. However, professionals in the field identify the availability of anonymous on-line marketplaces as ways to easily fence goods, and prosecutorial changes as being major factors contributing to the growth in ORC. • The growth in on-line marketplaces is highly correlated (61 percent) to the number of shoplifting events reported each year. • In addition, those retail categories most subject to shoplifting activities are also the ones most sought after through on-line marketplaces. • Nearly 67 percent of asset protection managers at leading retailers surveyed report a moderate to considerable increase in organized retail crime, while 80 percent believe it will only get worse in the future.  The economic impact of retail crime is profound. Retailers face increased costs for lost product, security, and labor, which lead to higher prices for consumers and ultimately, lower sales. Lower sales translate to fewer jobs throughout the economy. The result is $125.7 billion in lost economic activity and 658,375 fewer jobs, paying almost $39.3 billion in wages and benefits to workers. • Retail theft is not a problem just in major metropolitan areas, it is pervasive across America. In fact, one factor that is associated with lower levels of retail theft is the density of retail locations. • The impact of theft is felt through higher prices, and this impact is more acutely felt by low- and middle-income families. • It is estimated that retail theft costs federal and state governments nearly $15 billion in personal and business tax revenues, not including the lost sales taxes.

The Counterfeit Silk Road - Impact of Counterfeit Consumer Products Smuggled into the United States

The Buy Safe America Coalition represents a diverse group of responsible retailers, consumer groups, manufacturers, intellectual property advocates and law enforcement officials who support efforts at all levels of government to protect consumers and communities from the sale of counterfeit and stolen goods. One important issue facing US businesses is the massive growth in the availability and sales of illicit products, both from counterfeit imports — increasingly from China — and from products stolen from legitimate retailers and sold through online marketplaces, where the anonymity of a screenname has made it easier and more profitable to fence counterfeit and stolen goods. The Coalition asked John Dunham & Associates (JDA) to examine the data around these illicit sales to determine how they impact the US economy, federal tax revenues, and criminal activity. This is the first of a series of papers examining the issue of counterfeit and stolen goods and its effect on the United States economy. This analysis will focus on the importation of illicit products, notably counterfeits that violate producers’ intellectual property rights. Future analysis will examine the effects of domestic smuggling, the resale of stolen goods, and the effects of contraband on overall criminal activity. According to the analysis: • A large share of contraband items are delivered to US consumers by mail or by express consignment. These transactions account for over 60.8 percent of all seizures by the US customs service and over 90 percent of intellectual property rights (IPR) seizures. The growth in these types of shipments has increased along with the use of online marketplaces. Amazon, for instance, now derives more than 75 percent of their ecommerce revenue from marketplace sales. • In effect, as companies like the Chinese ecommerce marketplace Alibaba and the Amazon marketplace, have linked more consumers to more shippers, many companies producing illegitimate products have gained access to unwitting consumers in America. • The bulk of counterfeit products to the US come from China and its dependent territories, accounting for over 90.6 percent of all cargo with IPR violations. Of the $1.23 billion in total IPR violations intercepted, $1.12 billion was from China. • Examining just those data where CBP can provide an HS code, in some cases, the amount of contraband cargo is nearly equal to the entire import base. For example, imports of certain sweaters, jumpsuits and toys from China are almost 100 percent contraband, as are large amounts of handbags, jewelry and belts. • While there is substantial academic literature on the smuggling of narcotics, people and tobacco, there is very little written on counterfeit products. Using a very conservative model it is estimated that $44.3 billion in additional illicit cargo is escaping detection. • These lost sales alone mean that over 39,860 jobs in wholesaling and nearly 283,400 retail jobs are lost due to the impact of counterfeit goods skirting normal trade channels. All told, the sale of counterfeit items is expected to cost the wholesale and retail sectors of the US economy nearly 653,450 full-time equivalent jobs that pay over $33.6 billion in wages and benefits to US workers. • It is estimated that the smuggling of counterfeit goods costs the US government nearly $7.2 billion in personal and business tax revenues alone. • This analysis is based on the current level of CBP intercepts of illicit cargo. It is likely that the number of illegal imports is much larger than even estimated here.

The political economy of illicit drug crops: forum introduction

his article and the forum it introduces examine illicit drug crop (IDC) economies from agrarian perspectives. Examining IDCs as a group implies analysing how prohibition distinguishes them from other (licit) crops. We identify seven mechanisms through which prohibition shapes the agrarian political economy of IDCs and explore how these mechanisms and their effects generate distinctive patterns of development and political action amongst ‘illicit peasantries’. We also examine connections between illicit and licit crops, including how licit crop crises and illicit crop booms intertwine. We argue that IDC economies provide a bulwark for smallholders but are by no means peasant idylls.

A Framework for Countering Organised Crime: Strategy, Planning, and the Lessons of Irregular Warfare

Organised crime is not going well. According to the 2021 Global Organized Crime index, ‘the global illicit economy simply continue[s] along the upward trajectory it has followed over the past 20 years, posing an ever-increasing threat to security, development and justice – the pillars of democracy’ (Global Initiative, 2021, p. 8). Wherever governments seek to draw the line, criminal actors find profitable ways of crossing it; wherever governments fail to deliver on human need, criminal actors capitalise on citizens’ desire or despair. As of now, more than three-quarters of the world’s population ‘live in countries with high levels of criminality, and in countries with low resilience to organized crime’ (Global Initiative, 2021, p. 12). On aggregate, the associated activity amounts to an illicit form of governance, furnishing alternative services to a wide range of clients, be they the vulnerable and weak or a covetous elite. The breadth of organised crime, its clandestine nature, and its blending of creative and destructive effects make it difficult to counter. In past SOC ACE research, we argued that the response to organised crime often shares certain pitfalls with counterterrorism, at least since 9/11 (Ucko & Marks, 2022c). Both efforts have been stymied by 1) conceptual uncertainty of the problem at hand; 2) an urge to address the scourge head on (be it violence or crime), without acknowledging its socioeconomic-political context; and, therefore, 3) unquestioned pursuit of strategies that miss the point, whose progress is difficult to measure, and which may even be counterproductive. This convergence is based on the common features of the two phenomena, which are both concerned with i) collective actors, who ii) use violence and coercion among other methods; and who have iii) corrupting, or outright destructive effects on society. Though organised crime is not consciously political in its ideological motivation, it is – like terrorism – deeply political in its origins, activities, and effects. Given the conceptual overlap, and the common pathologies that undermine response, the lessons from countering terrorism are relevant also to the countering of organised crime. Focusing on the concept of ‘irregular warfare’, our past research identified six key lessons, touching upon 1) the socio-political embeddedness of the problem, 2) the tendency to militarise the response, 3) the mirror-imaging of state assistance programmes, 4) the invaluable role of community mobilisation, 5) the dearth of strategy, and 6) the need to engage more closely with questions of political will. As argued elsewhere, these challenges point to a need for greater strategic competence both in assessing the problem of organised crime and in designing a response (Ucko & Marks, 2022c).

To generate this strategic competence, this follow-on report sets out an analytical toolkit to assist planners and policymakers with the crafting of strategy. This ‘Framework of Analysis and Action’ builds upon lessons – negative and positive – learned via years of experience with irregular warfare, defined by the Department of Defense as ‘a violent struggle among state and non-state actors for legitimacy and influence over the relevant population(s)’ (U.S. Department of Defense, 2007, p. 1).1 It is a framework that finds its origins within the U.S. National Defense University’s College of International Security Affairs (CISA), where for two decades it has been used to teach strategic planning for complex and intensely political challenges (Ucko & Marks, 2022a). The framework consists of two parts: the Strategic Estimate of the Situation (which maps the problem, explores its drivers, frames, and methods, and critiques the current response) and the Course of Action (which uses the strategic estimate to design an appropriate strategy, guided by a theory of success). The framework is in this report adapted for organised crime, to enable the mapping of relevant actors and the crafting, thereby, of a viable response. By design, the framework responds to the six key lessons identified in our earlier work. This report goes through the framework and explains its adaptation to organised crime. Appendix A provides a summation of the toolkit, a ‘user’s guide’, that will facilitate application of the framework. Testing to date suggests great potential and we look forward to sustaining a dialogue with those engaged with countering organised crime to further evolve this toolkit. Indeed, since the beginning, this framework has been a living product, enriched by theoretical application in the classroom and practical use in the field.

Observatory of Illicit Economies in South Eastern Europe

In this issue, we focus on three cases where criminal groups from the region have been active in recent years: the Netherlands, Ecuador and parts of Africa.

These examples illustrate the growing involvement of Balkan criminal groups in some of the world’s hotspots for illicit activity. Research for these articles is facilitated by the Global Initiative’s network of contacts with local investigative journalists, as well as close cooperation between regional observatories of illicit economies, namely South Eastern Europe, West Africa and Latin America.

As part of the GI-TOC’s analysis of the risks of firearms trafficking from Ukraine, in this issue we show that the Western Balkans remain the main source of illegal weapons in Europe. At present, weapons are still cheap and plentiful in the region, and stockpiles have been augmented by inflows from Turkey via Bulgaria, particularly of gas and alarm guns. More on this topic can be found in a forthcoming GI-TOC report on trends in arms trafficking from the Ukraine conflict.

In this issue, we also report on a major crackdown by Serbian authorities in late 2023 on increasingly violent smugglers operating along the border between Serbia and Hungary, and examine how this has displaced migration flows towards Bosnia and Herzegovina.

Breaking the Devil's Pact: The Battle to Free the Teamsters from the Mob

In 1988, Manhattan U.S. Attorney Rudy Giuliani brought a massive civil racketeering suit against the leadership of the International Brotherhood of Teamsters (IBT), at the time possibly the most corrupt union in the world. The lawsuit charged that the mafia had operated the IBT as a racketeering enterprise for decades, systematically violating the rights of members and furthering the interests of organized crime. On the eve of trial, the parties settled the case, and twenty years later, the trustees are still on the job.

Breaking the Devil’s Pact is an in-depth study of the U.S. v. IBT, beginning with Giuliani’s lawsuit and the politics surrounding it, and continuing with an incisive analysis of the controversial nature of the ongoing trusteeship. James B. Jacobs and Kerry T. The violence dynamics in public security: military interventions and police-related deaths in Brazil

This paper discusses the deadly use of violence as a public security agenda, focusing on police lethality and military interventions. Through a literature review to understanding concepts – such as “war,” for example – used in public security policy agendas, the study seeks to frame the notion of political violence, mainly referring to the policies designed to combat violence in Brazil. The objective is to problematize the public security policy based on the idea of confrontation, which adopts the logic of war and the notion of “enemy”. The paper is divided into three parts. The first is a conceptual approach to violence and war, and the second is the analysis of the dynamic of deadly use of force. Finally, the third part is a contextual analysis of violence in Rio de Janeiro, its characteristics, and central actors, using official statistics on violence in the region.

Governing the underworld: how organized crime governs other criminals in Colombian cities

This article explores how organized criminal organizations exercise criminal governance over other organized and non-organized criminals using public messaging, lethal and extra-lethal violence. Drawing on extensive fieldwork, over 350 press reports, and an original database on inter-criminal lethal violence, we show, in line with recent literature on organized crime, that while these organizations use violence to build their reputation as actors willing to use force, they also provide benefits to other criminals such as financing and protection from state and competitors. This article contributes to the literature on criminal governance by elaborating on the mechanisms shown in recent work and by detailing an unexplored case study in Barranquilla (Colombia).

Shoplifting in mobile checkout settings: cybercrime in retail stores

Purpose: Retailers are implementing technology-enabled mobile checkout processes in their stores to improve service quality, decrease labor costs and gain operational efficiency. These new checkout processes have increased customer convenience primarily by providing them autonomy in sales transactions in that store employee interventions play a reduced role. However, this autonomy has the unintended consequence of altering the checks and balances inherent in a traditional employee-assisted checkout process. Retailers, already grappling with shoplifting, with an estimated annual cost of billions of dollars, fear that the problem may be exacerbated by mobile checkout and concomitant customer autonomy. The purpose of this paper is to understand the effect of mobile checkout processes in retail stores on cybercrime in the form of shoplifting enabled by a technology transformed the retail environment.

Design/methodology/approach The authors conducted an online survey of a US sample recruited from a crowdsourced platform. The authors test a research model that aims to understand the factors that influence the intention to shoplift in three different mobile checkout settings − namely, smartphone checkout settings, store-provided mobile device checkout settings, and employee-assisted mobile checkout settings − and compare it with a traditional fixed location checkout setting.

Findings The authors found that, in a smartphone checkout setting, intention to shoplift was driven by experiential beliefs and peer influence, and experiential beliefs and peer influence had a stronger effect for prospective shoplifters when compared to experienced shoplifters; in a store-provided mobile devices checkout setting, experiential beliefs had a negative effect on shoplifters’ intention to shoplift and the effect was weaker for prospective shoplifters when compared to experienced shoplifters. The results also indicated that in an employee-assisted mobile checkout setting, intention to shoplift was driven by experiential beliefs and peer influence, and experiential beliefs had a stronger effect for prospective shoplifters when compared to experienced shoplifters.

Originality/value This study is the among the first, if not first, to examine shoplifters’ intention to shoplift in mobile checkout settings. We provide insights into how those who may not have considered shoplifting in less favorable criminogenic settings may change their behavior due to the autonomy provided by mobile checkout settings and also provide an understanding of the shoplifting intention for both prospective and experienced shoplifters in different mobile checkout settings.

Enforcement of Drug Laws Refocusing on Organized Crime Elites

Illegal drug markets provide an immense source of power and revenue for organized criminal groups. That has remained the case despite the vast investment of political, financial, social, and military capital into the global “war on drugs,” which has also generated a vast and tragic human cost. Far from curtailing drug markets, which are in fact expanding in scale and complexity worldwide, repressive criminal justice and military responses to drug trafficking have exacerbated the already profound impacts of drug-related organized crime, from prolific violence in certain states to increased corruption, and undermined political and economic stability. Deep-seated schisms continue in international debates on drug policy. Despite renewed commitment to the prohibitionist approach at the March 2019 Ministerial Declaration of the United Nations (UN) Commission on Narcotic Drugs (CND), there is increasing acknowledgement within the UN system of the harms of the current drug control regime, and the need to pursue options such as decriminalization of use and possession for personal use. Countries are increasingly adopting decriminalization models, and the legalization and regulation of cannabis for recreational use is becoming a reality in a number of jurisdictions. Yet at the same time, other countries have moved in the opposite direction, redoubling efforts to eradicate drug use through punitive approaches which harm health and human rights. Given this highly polarized context, the need for reform-minded states to advocate for evidence-based responses to organized crime and drug trafficking is greater than ever. This report supports this effort by building on the five key pathways towards improving drug policy as outlined in the Global Commission’s 2014 report. Alongside strategies to ensure the health and safety of those using drugs, this coherent five-fold program advocates for refocused enforcement responses to drug trafficking and organized crime as an essential part of drug policy reform. This report provides an overview of how the global “war on drugs” has, counter to its ostensible aims, fed and empowered transnational organized crime. More effective responses to transnational organized crime and drug trafficking – through both targeted and measured law enforcement approaches and development strategies which counter the root causes of organized crime – are possible and may be enacted even while markets remain illegal. The legal regulation of drugs offers an unprecedented opportunity to move drugs markets out of criminal control, as the Global Commission stated last year, but also presents new challenges for countering organized crime. This report explores lessons learned both in a context of prohibition and of a legally regulated market. Implementation of more progressive drug policies has often been held back by the international control regime; through a lack of coherence among UN entities, between regional bodies, and the deep-seated conservatism in the international regime. As such, this report considers the past record of the international drug control regime with respect to the fight against drug trafficking, and how more effective coordination could be achieved in the future, if political will is to be found.

Rapid changes in illegally manufactured fentanyl products and prices in the United States

Background and aims: Synthetic opioids, mostly illegally manufactured fentanyl (IMF), were mentioned in 60% of United States (US) drug overdose deaths in 2020, with dramatic variation across states that mirrors variation in IMF supply. However, little is known about IMF markets in the United States and how they are changing. Researchers have previously used data from undercover cocaine, heroin, and methamphetamine purchases and seizures to examine how their use and related harms respond to changes in price and availability. This analysis used US Drug Enforcement Administration (DEA) data to address two questions: (i) “To what extent does IMF supply vary over time and geography?” and (ii) “What has happened to the purity-adjusted price of IMF?” Methods: We developed descriptive statistics and visualizations using data from 66 713 observations mentioning IMF and/or heroin from the DEA’s System to Retrieve Information from Drug Evidence (STRIDE; now STARLIMS) from 2013 to 2021. Price regressions were estimated with city-level fixed effects examining IMF-only powder observations with purity and price information at the low-to-medium wholesale level (>1 g to ≤100 g; n = 964). Results: From 2013 to 2021, the share of heroin and/or IMF observations mentioning IMF grew from near zero to more than two-thirds. The share of heroin observations also containing IMF grew from <1% to 40%. There is important geographic variation: in California, most IMF seizures involved counterfeit tablets, whereas New York and Massachusetts largely involved powder formulation. The median price per pure gram of IMF powder sold at the >10 to ≤100 g level fell by more than 50% from 2016 to 2021; regression analyses suggested an average annual decline of 17% (P < 0.001). However, this price decline appears to have been driven by observations from the Northeast. Conclusions: Since 2013, the illegally manufactured fentanyl problem in the United States has become more deadly and more diverse.

Prevalence of cannabis use in youths after legalization in Washington state

Methods| The Washington Healthy Youth Survey (HYS) 2 is an anonymous, school-based survey of 8th, 10th, and 12th graders and the state’s primary source of information about health behavior among youths. The HYS has been implemented in the fall of even-numbered years since 2002, using a simple random sample of public schools to generate a state-representative sample. Response rates (incorporating school and student response) in 2016 were 80% for 8th grade, 69% for 10th grade, and 49% for 12th grade. The study was approved by the Washington State Institutional Review Board, whose general policy waives informed patient consent when data are de-identified. We Generated Covariate-adjusted prevalence estimates, modeling as closely as possible to Cerdá et al. Prevalence was based on modeled estimates (ie, SUDAAN predMARG [RTI International] postestimation command). Because the the MTF is not designed to provide state-representative estimates, the article generated covariate-adjusted modeled prevalence estimates for each state. The article suggested complex association between legalization and cannabis use among youths: increases in prevalence among Washington 8th and 10th graders, but not among 12th graders, relative to use in states without legalization of recreational marijuana.

The authors noted that, “the sample design may lead to discrepancies between MTF results and those found in other large-scale surveillance efforts.”1(p148) The purpose of the present study was to assess whether trends in cannabis use prevalence among youths from Washington’s state-based youth survey are consistent with findings from the MTF.

Gender Differences in Drug Use among Individuals Under Arrest

  Background: Drug monitoring by drug testing of individuals under arrest provides an opportunity to detect drug use patterns within geographic areas. However, women have been omitted from large-scale monitoring efforts in criminal justice populations. The purpose of this study was to examine whether gender differences exist in drug use indicated by oral fluid collected in one U.S. jail. Methods: The study analyzed data collected in 2019-2020 from individuals under arrest (N = 191). Twenty-four percent of the sample identified as female. Oral fluid specimens were collected and then analyzed with enzyme-linked immunosorbent assay and liquid chromatography/tandem mass spectrometry. Logit regression models examined gender differences. Results: Women were more likely to test positive for methamphetamines than men (41% versus 22%, OR = 0.42, 95% CI 0.21-0.84). Significant gender differences were not found for other substances (marijuana, cocaine, and opioids), legality of drugs, or overall drug use. Conclusions: Because the National Institute on Drug Abuse aims to promote health equity, future drug monitoring in criminal justice populations should employ sampling approaches representing both women and men. This research would identify possible gender-based patterns of drug use and inform gender-based policies and clinical practices to prevent and treat drug misuse.

Implementing and Enforcing EU Criminal Law: Theory and Practice

This book is the result of an academic project, funded by the Hercules Programme of the European Commission to study legislation dealing with crimes against the Financial Interest of the EU awarded to the Department of  European and Comparative Law within the Faculty of Laws of the University of Malta. The study deals with the notion of criminal law at the European Union level as well as the relationship between the EU legal order and the national legal order. The focus of the study is on the development of EU criminal legislation aimed at protecting the financial interests of the EU, with a focus on cybercrime, fraud and public spending. It starts with the current legal basis in the TFEU, followed by the development of EU legislation in the area as well as the legislation of relevant bodies, such as EPO, OLAF and EUROPOL. The study tackles how this legislation is being received by the national legal orders, whereby eleven EU Member States are selected based on size, geography and legal systems. These Member States are France, Ireland, Croatia, Estonia, Germany, Italy, Malta, Spain, Latvia, Greece and Poland. A comparative study is made between those sections of EU criminal law dealing with the financial interests of the EU in these Member States to analyse the current legislation and propose future developments. The study, which is led by the editors based at the University of Malta, examines the subject from a European perspective. Besides the European perspective, the  study focuses on national case-studies, followed by a comparative analysis.

Measuring cybercrime in Europe: The role of crime statistics and victimisation surveys. Proceedings of a conference organized by the Council of Europe with the support of the European Union

Cybercrime has become part of everyday life. We live in hybrid societies, fluctuating between the material and the virtual world, and we are hence confronted with online, offline and hybrid offences. However, the few victimisation surveys conducted in Europe reveal that victims of online crimes seldom report them to the police. Consequently, cybercrimes – which according to the best estimates represent between one third and more than half of all attempted and completed crimes in Europe – seldom appear in national criminal statistics. The State seems powerless to prevent them and private security companies flourish. 

During two days, experts from all over the continent gathered together in the framework of a virtual conference organized by the Council of Europe and the European Union to discuss what we know, what we do not know, and what we could do to improve our knowledge of crime in our contemporary hybrid societies, develop evidence-based criminal policies, provide assistance to crime victims, and implement realistic programs in the field of crime prevention and offender treatment. This book presents their experiences, reflexions, and proposals.
